Terms of Use and Booking Conditions
Welcome to Tealigo. Please review these Terms of Use and Booking Conditions carefully. They govern your use of the Tealigo platform, searches, and all hotel and flight reservations made through our service.
1.Agreement and Incorporated Terms
These Terms, the booking confirmation, the rate rules shown before payment, the applicable property or supplier conditions, the Cancellation and Refund Policy, the TealPoints Terms, Privacy Policy and any other policy expressly incorporated by reference form the entire agreement governing the booking. If there is a conflict, the booking-specific rate rules and mandatory law take priority.
2.Eligibility and Authority
You must be at least 18 years old and legally capable of entering a binding contract. If you book for another traveller, you represent that you are authorised to act for that person, have provided them with all applicable terms, and remain responsible for payment, accurate information and booking instructions.
3.Tealigo's Role
Tealigo owns and operates the booking platform and may collect payment as merchant of record. The accommodation, room, facilities, hospitality and on-site services are provided and controlled by the property and relevant travel suppliers, which are independent businesses and not Tealigo's employees, agents, partners or joint venturers. Tealigo does not own, manage, inspect or operate the property.
4.Supplier Information and No Endorsement
Property names, descriptions, photographs, star ratings, maps, amenities, accessibility information, room details, availability, prices and policies are supplied by properties, RateHawk/ETG or other third parties. They are displayed for information and do not constitute Tealigo's endorsement, certification or independent warranty. Photographs and ratings are illustrative and may not reflect current conditions.
5.Search Results and Availability
Search results are invitations to make a booking request, not binding offers. Tealigo does not guarantee that any property, room, price, promotion, reward, special request or amenity will remain available. Availability and price must be rechecked before payment and may change until confirmation is issued.
6.Obvious Errors and Corrections
Tealigo may correct obvious pricing, tax, currency, availability, content or technical errors. Where a booking was made at an obviously incorrect price or on materially incorrect information, Tealigo may offer the corrected terms or cancel and refund the amount received, to the extent permitted by applicable law. Tealigo is not required to honour an obvious error that a reasonable customer should have recognised.
7.Confirmation and Contract Formation
A booking is confirmed only when Tealigo sends a booking confirmation containing a valid booking reference. A payment authorisation, pending card entry, search result, checkout screen or automated acknowledgement is not confirmation. Tealigo may reject a request before confirmation for availability, payment, sanctions, fraud, supplier, technical or compliance reasons.
8.Prices, Taxes and Local Charges
The checkout page identifies the amount collected by Tealigo and known included taxes or fees. Properties may separately collect deposits, resort fees, city taxes, incidental charges or other mandatory amounts where disclosed or lawfully imposed. Card issuers may charge currency-conversion, cross-border or other fees for which Tealigo is not responsible.
9.Payments, Verification and Fraud
Payments are processed through Stripe or another disclosed provider. Tealigo may perform identity, payment, sanctions and fraud checks and request supporting information. Tealigo may refuse, suspend or cancel affected transactions and accounts where misuse, unauthorised payment, sanctions exposure, chargeback abuse or suspicious activity is reasonably suspected.
10.Supplier Rules and Restrictions
The selected property's and supplier's rules concerning payment, occupancy, age, identification, deposits, check-in, cancellation, no-show, pets, smoking, damage, conduct, accessibility and other restrictions apply and are incorporated into the booking. A breach may result in refusal of service, removal, cancellation or loss of amounts paid.
11.Traveller Documents and Destination Risk
You are solely responsible for passports, visas, immigration status, health requirements, travel authorisations, insurance, destination rules and checking official travel advice. Tealigo does not warrant that travel to any destination is advisable, safe or lawful for you and does not provide immigration, medical, tax or legal advice.
12.Special Requests and Accessibility
Special requests, including bedding, adjoining rooms, early arrival, late departure, dietary needs and accessibility features, are not guaranteed unless expressly confirmed by the property in writing. You must verify essential accessibility or medical requirements directly with the property before travel.
13.Changes, Cancellation, No-Show and Refunds
Your rights depend on the booking-specific rate rules displayed before payment. You have no automatic right to amend or cancel unless the rate rules or mandatory law allow it. Non-refundable rates may remain fully payable. No-shows, late arrivals and early departures may be charged in full. A cancellation is effective only when confirmed through Tealigo or the supplier.
14.Property or Supplier Failure
A property or supplier may overbook, close, become insolvent, change facilities, relocate guests or fail to perform. Tealigo will provide reasonable booking support and pass through remedies made available by the supplier. Except where Tealigo directly caused the failure or mandatory law provides otherwise, claims concerning the actual accommodation service must be pursued against the property or responsible supplier.
15.Platform Provided As Available
To the maximum extent permitted by law, the platform, content, communications, software and support tools are provided 'as is' and 'as available'. Tealigo disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, accuracy, security and freedom from harmful components, except where such warranties cannot lawfully be excluded.
16.No Fiduciary or Advisory Relationship
Use of the platform does not create a fiduciary, employment, agency, partnership, joint venture, professional-adviser or special relationship between you and Tealigo. Recommendations, rankings, AI output and search ordering are informational tools and must not be treated as professional or guaranteed advice.
17.Excluded Losses
To the maximum extent permitted by law, Tealigo and its affiliates, directors, officers, employees, contractors and service providers are not liable for indirect, incidental, special, exemplary, punitive or consequential loss; loss of profits, revenue, business, contracts, opportunity, anticipated savings, enjoyment, goodwill or data; business interruption; or costs that could reasonably have been avoided.
18.Third-Party Acts and Travel Services
To the maximum extent permitted by law, Tealigo is not liable for acts, omissions, negligence, insolvency, misrepresentation, breach, personal injury, death, property damage, service failure or other conduct of a property, supplier, payment provider, transport operator or other independent third party, except to the extent directly caused by Tealigo's own breach and not lawfully excludable.
19.Liability Cap
Subject to the non-excludable liabilities below, Tealigo's total aggregate liability arising from one booking or a series of connected events will not exceed the lower of: (a) the amount paid to Tealigo for the affected booking; and (b) USD 250. This cap does not prevent repayment of a proven overcharge or duplicate charge caused by Tealigo. For consumers in jurisdictions where this cap is prohibited or unfair, liability is limited only to the maximum extent permitted by mandatory law.
20.Non-Excludable Liability
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence where it cannot be limited, death or personal injury directly caused by negligence where exclusion is prohibited, or any other liability or statutory consumer right that applicable law does not permit the parties to exclude or limit.
21.Duty to Mitigate and Prompt Notice
You must take reasonable steps to reduce avoidable loss, notify Tealigo and the property promptly of any problem, allow a reasonable opportunity to correct it, and provide supporting evidence. Tealigo is not responsible for loss that could reasonably have been avoided or reduced through prompt action.
22.Force Majeure
Neither Tealigo nor the affected supplier is liable for delay or failure caused by events beyond reasonable control, including severe weather, natural disaster, epidemic, war, terrorism, civil disorder, government action, border closure, sanctions, labour dispute, utility or telecommunications failure, cyberattack, transport disruption or supplier system failure. Obligations affected by the event are suspended for its duration, subject to mandatory refund rights.
23.Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify and hold harmless Tealigo and its affiliates, officers, directors, employees, contractors and suppliers from third-party claims, losses, fines, penalties, damages and reasonable professional fees arising from your breach of these Terms, unlawful or fraudulent conduct, infringement of third-party rights, misuse of another person's data, unauthorised payment method, damage caused by you or travellers in your booking, or content you submit. This obligation does not apply to losses directly caused by Tealigo's own unlawful conduct.
24.Account Security and Unauthorised Use
You are responsible for protecting credentials and for activity conducted through your account until you notify Tealigo of suspected compromise. Tealigo may suspend access, require verification, reset credentials or cancel affected transactions to protect users or the platform.
25.Prohibited Conduct
You must not make false, speculative or fraudulent bookings; resell inventory without authorisation; scrape or systematically copy data; bypass security or rate limits; reverse engineer software; manipulate prices, referrals or rewards; upload malware; misuse reviews or personal data; impersonate another person; or violate sanctions, export controls or applicable law.
26.Third-Party Links and Services
Links, maps, reviews, loyalty programmes and third-party services are provided for convenience. Tealigo does not control or endorse them and is not responsible for their availability, content, security, privacy or performance. Separate third-party terms apply.
27.AI and Automated Content
AI-generated summaries, recommendations, translations and support responses may be incomplete, outdated or inaccurate and are provided for convenience only. You must verify important booking, destination, health, legal and accessibility information from authoritative sources. Tealigo is not liable for reliance on AI output except where liability cannot lawfully be excluded.
28.Claims and Records
You should submit complaints promptly and retain confirmations, receipts, photographs and correspondence. Any contractual notice period does not shorten a statutory limitation period or mandatory consumer right. Tealigo may preserve relevant transaction and support records for legal, fraud and dispute purposes.
29.US Dispute Resolution
For customers resident in the United States, Tealigo may adopt an individual binding arbitration agreement, class-action waiver and jury-trial waiver with a clear 30-day opt-out process. This provision must not be activated or published until reviewed and approved by qualified US counsel and implemented with legally sufficient notice and assent.
30.Governing Law and Mandatory Consumer Rights
These Terms are governed by Delaware law, excluding conflict-of-law rules. This choice does not deprive a consumer of mandatory protections or courts available under the law of the consumer's habitual residence. Any arbitration clause applies only where valid and properly accepted.
31.Severability, Survival and No Waiver
If a provision is invalid or unenforceable, it will be enforced to the maximum lawful extent and the remainder will continue. Liability limits, indemnities, payment obligations, intellectual-property rules and dispute provisions survive termination. Failure to enforce a right is not a waiver.
32.Changes to These Terms
Tealigo may update these Terms for legal, regulatory, tax, security, supplier or product reasons. The version accepted at booking governs that booking unless mandatory law requires otherwise. Material changes affecting account use will be notified where required.
